1. Acceptance of Terms
By engaging Calyx Title Services LLC you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not use our services.
2. Scope of Services
The Company provides real estate title search and examination services based on public records. Our reports reflect the state of recorded documents as indexed in the relevant county and municipal records. Services include current owner searches, two-owner searches, and full 60-year searches as specified in your individualized service agreement.
3. Limitation of Liability
Our title searches are compiled using publicly available records. The Company is not liable for unrecorded liens, encumbrances, improperly indexed records, fraud, forgery, or identity theft affecting title history. Liability for negligence is strictly limited to the fee paid for the specific title search.
4. No Legal or Title Insurance Advice
The Company provides factual data regarding public property records and does not provide legal advice. A title search is not a commitment to issue title insurance. We strongly recommend obtaining an owner’s title insurance policy.
5. Fees and Payment Terms
Fees for title searches are outlined in our current rate sheet or proposal. Payment is due within 15 days of the invoice date unless otherwise agreed in writing. Additional fees may apply for expedited or complex searches.
6. Turnaround Times
Estimated turnaround times vary based on the product service requested. Delays caused by county office closures, courts, or third-party public access systems are beyond our control.
7. Confidentiality and Data Privacy
The Company respects your privacy and uses industry-standard measures to protect your information while processing title search requests.
8. Termination of Services
Either party may terminate services with written notice. Orders cancelled after work has commenced may incur charges for completed work.
9. Governing Law
These Terms and Conditions are governed by the laws of the State of Alabama. Any disputes shall be subject to the jurisdiction of Alabama courts.
